It is one of the most common pathways to long-term residence in Peru and also authorizes both dependent and independent work.<\/p><p data-start=\"642\" data-end=\"881\">This article explains who qualifies, which documents are required, how the procedure works, applicable deadlines, rights and obligations, and the medium- and long-term options available, such as permanent residence or Peruvian nationality.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1ec24f0 elementor-widget elementor-widget-heading\" data-id=\"1ec24f0\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Who qualifies for this visa?<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e7beebd elementor-widget elementor-widget-text-editor\" data-id=\"e7beebd\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p data-start=\"921\" data-end=\"1032\">The following persons may apply for the <strong data-start=\"961\" data-end=\"1012\">Resident \u2013 Family Member of a Peruvian National<\/strong> immigration status:<\/p><ul data-start=\"1034\" data-end=\"1579\"><li data-start=\"1034\" data-end=\"1102\"><p data-start=\"1036\" data-end=\"1102\">A foreign national who is legally married to a Peruvian citizen.<\/p><\/li><li data-start=\"1103\" data-end=\"1391\"><p data-start=\"1105\" data-end=\"1391\">A foreign national who is the registered partner of a Peruvian citizen, provided that the de facto union has been formally recognized through a notarial or judicial procedure, registered with SUNARP, and proves at least two years of continuous cohabitation at the time of application.<\/p><\/li><li data-start=\"1392\" data-end=\"1579\"><p data-start=\"1394\" data-end=\"1579\">A foreign national married to another foreigner who holds Peruvian residence based on a work visa, as long as both the employment relationship and the marital relationship remain valid.<\/p><\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-55751a5 elementor-widget elementor-widget-heading\" data-id=\"55751a5\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Nature of the residence and validity<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f0a41b7 elementor-widget elementor-widget-text-editor\" data-id=\"f0a41b7\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p data-start=\"1627\" data-end=\"1786\">This visa grants <strong data-start=\"1644\" data-end=\"1663\">resident status<\/strong> and authorizes the holder to engage in paid activities in Peru, whether as an employee or as a self-employed professional.<\/p><p data-start=\"1788\" data-end=\"1994\">The residence is granted for <strong data-start=\"1817\" data-end=\"1830\">two years<\/strong> and is renewable. The renewal request must be submitted before the expiration date; as a best practice, it is recommended to apply at least <strong data-start=\"1971\" data-end=\"1993\">30 days in advance<\/strong>.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-582500a elementor-widget elementor-widget-heading\" data-id=\"582500a\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Key preliminary conditions<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-91c5120 elementor-widget elementor-widget-text-editor\" data-id=\"91c5120\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p data-start=\"2032\" data-end=\"2434\">At the time of filing the application, the foreign national must be in <strong data-start=\"2103\" data-end=\"2133\">regular immigration status<\/strong>, holding a valid visa or authorized stay. If the applicant entered Peru as a tourist, the change of immigration status must be submitted before the tourist stay expires. Tourist visas <strong data-start=\"2318\" data-end=\"2362\">cannot currently be extended within Peru<\/strong>, so overstaying generally requires leaving the country and re-entering.<\/p><p data-start=\"2436\" data-end=\"2864\">The applicant must also <strong data-start=\"2460\" data-end=\"2509\">have no criminal, judicial, or police records<\/strong> in their country of origin or in any country where they have previously resided. These certificates must be apostilled or legalized. For U.S. citizens, an <strong data-start=\"2665\" data-end=\"2689\">FBI Background Check<\/strong> with federal apostille is mandatory. Any criminal record reflected in the certificate, regardless of how old it is, may result in the application being declared inadmissible.<\/p><p data-start=\"2866\" data-end=\"3169\">The Peruvian spouse or partner must hold a <strong data-start=\"2909\" data-end=\"2936\">valid Peruvian ID (DNI)<\/strong> with the correct and updated civil status before the immigration process begins. This is especially important when the marriage is celebrated in Peru, as registration with RENIEC and the subsequent DNI update may take several weeks.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-0cbc17d elementor-widget elementor-widget-heading\" data-id=\"0cbc17d\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Required documentation \u2013 Marriage route<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-bbd3689 elementor-widget elementor-widget-text-editor\" data-id=\"bbd3689\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p data-start=\"3220\" data-end=\"3348\">When applying based on marriage to a Peruvian citizen, the foreign applicant must submit, among others, the following documents:<\/p><ul data-start=\"3350\" data-end=\"3812\"><li data-start=\"3350\" data-end=\"3419\"><p data-start=\"3352\" data-end=\"3419\">A valid passport (a minimum validity of one year is recommended).<\/p><\/li><li data-start=\"3420\" data-end=\"3475\"><p data-start=\"3422\" data-end=\"3475\">Criminal background check from country of origin; U.S. citizen: FBI Background Check apostilled in Washington, D.C.\u00a0<\/p><\/li><li data-start=\"3476\" data-end=\"3749\"><p data-start=\"3478\" data-end=\"3749\">A recent marriage certificate. If the marriage was celebrated outside Peru, it must be apostilled; if it was celebrated in Peru, a recent certified copy from RENIEC is required. If the document is not in Spanish, it must be translated in Peru by an official translator.<\/p><\/li><li data-start=\"3750\" data-end=\"3812\"><p data-start=\"3752\" data-end=\"3812\">A valid INTERPOL International Exchange Form issued in Peru.<\/p><\/li><\/ul><p data-start=\"3814\" data-end=\"4050\">The Peruvian spouse must submit a valid DNI with updated civil status and a sworn declaration of the family residence address using Migraciones\u2019 official forms. If the marriage took place abroad, it must first be registered with RENIEC.<\/p><p data-start=\"4052\" data-end=\"4206\">As a general rule, documents issued abroad are usually considered valid for <strong data-start=\"4128\" data-end=\"4142\">six months<\/strong>, while documents issued in Peru are valid for <strong data-start=\"4189\" data-end=\"4205\">three months<\/strong>.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3f0e97a elementor-widget elementor-widget-heading\" data-id=\"3f0e97a\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Required documentation \u2013 De facto union route<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-62df0d9 elementor-widget elementor-widget-text-editor\" data-id=\"62df0d9\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p data-start=\"4263\" data-end=\"4529\">When the application is based on a de facto union, the applicant must submit the notarial or judicial record recognizing the union, duly registered with SUNARP, proving at least <strong data-start=\"4441\" data-end=\"4481\">two years of continuous cohabitation<\/strong>. The Peruvian partner\u2019s DNI must be up to date.<\/p><p data-start=\"4531\" data-end=\"4776\">In addition, the foreign applicant must submit the remaining required documents, such as a valid passport, apostilled criminal records from the country of origin, and the INTERPOL form, under the same conditions applicable to the marriage route.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b90d5ee elementor-widget elementor-widget-heading\" data-id=\"b90d5ee\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">General procedure overview<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b3c1816 elementor-widget elementor-widget-text-editor\" data-id=\"b3c1816\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p data-start=\"4814\" data-end=\"5137\">The process begins with collecting the required apostilled documents and, when applicable, having them officially translated into Spanish in Peru. The applicant must then obtain the INTERPOL form and verify that the Peruvian spouse or partner\u2019s DNI is updated and that the marriage or de facto union is properly registered.<\/p><p data-start=\"5139\" data-end=\"5560\">Next, the corresponding government fee is paid at the Banco de la Naci\u00f3n, and the application for change of immigration status is submitted through the <strong data-start=\"5291\" data-end=\"5321\">Migraciones Digital Agency<\/strong>. Once an application number is issued, the applicant receives access credentials to the digital platform in order to schedule the first in-person appointment, during which biometric data (photo, signature, and fingerprints) are collected.<\/p><p data-start=\"5562\" data-end=\"5849\">Migraciones may issue observations or requests for additional information during the process. Once the application is approved, a provisional certificate of the Foreigner ID (Carn\u00e9 de Extranjer\u00eda) with a QR code is issued, followed by a final appointment to collect the physical ID card.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-63ea87b elementor-widget elementor-widget-heading\" data-id=\"63ea87b\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Rights and obligations<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7775817 elementor-widget elementor-widget-text-editor\" data-id=\"7775817\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p data-start=\"5883\" data-end=\"6210\">Holders of this residence permit have the right to live and work legally in Peru with their Carn\u00e9 de Extranjer\u00eda. They are also required to maintain the family relationship that gave rise to the residence, report any changes of address or civil status, and ensure timely renewal or change of immigration status when applicable.<\/p><p data-start=\"6212\" data-end=\"6342\">Migraciones is authorized to verify the accuracy of the declared residence and to monitor compliance with immigration obligations.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a96f6a6 elementor-widget elementor-widget-heading\" data-id=\"a96f6a6\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Residence renewal<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8989251 elementor-widget elementor-widget-text-editor\" data-id=\"8989251\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Family Member of a Peruvian National residence is granted for two years and may be renewed as long as the family relationship and documentation remain valid. Renewal should be requested at least <strong data-start=\"6566\" data-end=\"6595\">30 days before expiration<\/strong>.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c9ba6cb elementor-widget elementor-widget-heading\" data-id=\"c9ba6cb\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Path to permanent residence<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-9affc3e elementor-widget elementor-widget-text-editor\" data-id=\"9affc3e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p data-start=\"6635\" data-end=\"6796\">After <strong data-start=\"6641\" data-end=\"6686\">three years of continuous legal residence<\/strong>, the foreign national may apply for <strong data-start=\"6723\" data-end=\"6745\">Permanent Resident<\/strong> status, which is granted for an indefinite period.<\/p><p data-start=\"6798\" data-end=\"7131\">During this time, absences from Peru must not exceed <strong data-start=\"6851\" data-end=\"6901\">183 consecutive days within any 365-day period<\/strong>, unless prior authorization has been obtained. Importantly, the calculation of these periods begins on the date the residence is approved by Migraciones, not on the date of entry into Peru or the start of the application process.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-885f8e0 elementor-widget elementor-widget-heading\" data-id=\"885f8e0\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Peruvian nationality and recent changes<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f8bb6d1 elementor-widget elementor-widget-text-editor\" data-id=\"f8bb6d1\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p data-start=\"7182\" data-end=\"7540\">Depending on the circumstances, family-based residence may also lead to Peruvian nationality. <a href=\"https:\/\/nvcabogados.com\/peru-new-nationality-law\/\" target=\"_blank\" rel=\"noopener\">Recent legal changes<\/a> have increased some requirements, particularly for nationality by marriage, which now requires four years of continuous marriage and valid immigration residence in Peru. General naturalization requires five years of continuous legal residence.<\/p><p data-start=\"7542\" data-end=\"7860\">Peru allows <strong data-start=\"7554\" data-end=\"7589\">dual and multiple nationalities<\/strong>, meaning applicants are not required to renounce their previous nationality.
