Recovery of Peruvian nationality

If you were born in Peru and gave up your Peruvian citizenship to obtain another one—such as German or American nationality—you have the right to recover your Peruvian nationality at any time. Below you’ll find the full legal basis, eligibility criteria, and step-by-step guidance to complete the recovery process, even from abroad.

It is worth highlighting that this important legal reform was actively promoted by groups of Peruvian citizens living abroad—especially in countries such as Germany, Spain, France, the Netherlands, and other European nations that did not recognize dual nationality, as well as by Peruvians with U.S. citizenship. Through multiple petitions and public statements, ongoing communication with diplomatic authorities in their countries of residence, and even direct meetings with members of the Peruvian Congress, these communities successfully advocated for the removal of the previous requirement, which forced applicants to physically reside in Peru with a foreign resident card (carné de extranjería) for at least one year before initiating the recovery process.

Thanks to the tireless efforts and determination of these Peruvian communities abroad—motivated by their desire to reclaim their civil rights and driven by the recognition of the right to return and preserve their national identity—the National Superintendence of Migration reformed its administrative procedures. Today, digital channels allow the entire process to be carried out from abroad, without the need to return and reside in Peru beforehand.

To all those who contributed to this achievement: we extend our deep gratitude for defending not only their right to recover Peruvian nationality but also the legal right to pass it on to their children born abroad.

Legal Framework

The recovery of Peruvian nationality is primarily governed by Articles 8 and 9 of Law No. 26574 – Nationality Law, as well as its Regulations approved by Supreme Decree No. 004-97-IN.

According to this legal framework, any Peruvian citizen by birth who renounced their nationality to obtain another may recover it at any time by submitting a formal request to the National Superintendence of Migration (Migraciones).

The amendment introduced by Law No. 31738 (May 2023) reinforces the principle of perpetual nationality, facilitating a more accessible process that reflects the international recognition of dual citizenship.

Who can apply for the recovery of Peruvian nationality?

This process is available to persons born on Peruvian territory who explicitly renounced their Peruvian nationality upon acquiring a foreign nationality—often due to legal or migratory requirements, such as those imposed by Germany before changes in its dual citizenship law.

Required documents

To begin the process, the applicant must submit the following:

    • A formal written request addressed to Migraciones

    • A simple copy of the Peruvian birth certificate

    • A copy of a valid foreign passport

    • Document proving renunciation of Peruvian nationality (if available)

    • International INTERPOL record (Ficha de Canje)

    • Sworn statement of no criminal convictions or pending legal proceedings

    • Proof of address in Peru or a consular certificate if living abroad

    • Proof of payment for the administrative fee

How to apply online

Since 2023, this procedure can be completed via the official Migraciones Digital Platform:

Through the platform, you can:

  • Upload all required documents in digital format

  • Pay the application fee online

  • Schedule an optional in-person appointment (for document signing or identity verification)

Processing time

The application is generally processed within 30 business days from the date of official acceptance. However, the timeframe may be extended if additional information is requested.

Oath Ceremony & Certificate of Nationality

Once approved, the applicant is invited to take an oath of loyalty to the Republic of Peru. During this short official ceremony, the applicant receives the Certificate of Nationality by Recovery, which fully restores Peruvian nationality and takes immediate legal effect before all public and governmental institutions.

How to get your DNI

With the Certificate of Nationality, you can apply for a new DNI (Documento Nacional de Identidad) at RENIEC.

Documents required:

  • Copy of the Certificate of Nationality

  • Copy of the Peruvian birth certificate

  • Proof of payment (approx. S/ 35.00)

RENIEC will issue a new DNI, which fully restores your civil rights as a Peruvian citizen.

Obtaining your Peruvian passport

Once you have your DNI, you can apply for your electronic Peruvian passport:

  • At Migration offices in Peru

  • At a Peruvian consulate abroad

  • Or, in urgent cases, at service centers or even at the airport in Peru (for emergency passports within 24 hours of departure, with proof of your flight and payment of the corresponding fee)

  • Valid DNI

  • Payment of the passport fee

  • Appointment via the official portal

  • In-person biometric capture (photo, fingerprint, signature)

  • There is no time limit to apply for the recovery of nationality.
